Italian court ordered government to launch a campaign to advise the public of the health risks from mobile and cordless phones

In a victory for advocates of precaution, an Italian court has ordered the government to launch a campaign to advise the public of the health risks from mobile and cordless phones.

The information campaign must begin by July 16.

The court in Rome reached its decision last November, but the announcement was only made yesterday.

The government announced that it would not appeal the ruling, Stefano Bertone told Microwave News. Bertone is with the law firm of Ambrosio and Commodo in Turin, and is helping represent a citizens group called APPLE, which sued to force the government to act. APPLE is an acronym for the Association for the Prevention of and Fight Against Electrosmog.

In a joint press release, three different ministries — of Health, of Environment and of Education and Research — acknowledge that there is a need to raise public awareness on how to use mobile phones safely.

“This case has important implications not only in Italy, but worldwide,” Bertone said. “At the moment, health and safety information is contained —or, I should say, buried— in cell phone manuals. This is not good enough. If it was, the court would have agreed with the government that sufficient information is already available.”

In October 2012, the Italian Supreme Court affirmed a ruling granting a claim for workers compensation filed by a businessman who claimed that his use of a cell phone for 12 years had caused a tumor to develop on one of his cranial nerves (the trigeminal nerve). Gino Angelo Levis, a founder of APPLE, was an expert witness for the plaintiff.

Court rules on information on health risks from wireless phones

“No doubt this is a victory for public health. Similar decision should be made in all countries. We have the knowledge of health risks but the population is not informed due to negligence by government and media like in Sweden. We have the scientific evidence on risks to human beings and also the environment by no action in undertaken. Instead, the 5th generation, 5G, of wireless communication is implemented without proper scientific studies on the risks”. (

Following the announcement by the Italian government that it was not appealing his conviction, the judgment published on November 13, 2018 was widely relayed by the  Italian media: 

So must declare the obligation of the Ministry of the environment, the Ministry of Health and the Ministry of Education, University and Research, each for his own field of competence, to ensure, pursuant to the provisions of art. 10 of the Law n. 36/2001, to adopt an information campaign, addressed to the entire population, concerning the identification of the correct methods of use of mobile telephones (cell phones and cordless phones) and information on the risks health and environmental issues related to the misuse of these devices.

The above-mentioned information and environmental education campaign shall be implemented within six months of notification or, if earlier, of the administrative communication of this judgment, using the means of the most appropriate communication to ensure wide dissemination of the information it contains.

We owe this tremendous progress to the work of Professor Angelo Levis and the association” APPLE – ( chaired by Laura Masiero and their lawyers: Renato Ambrosio, Stefano Bertone, Chiara Ghibaudo, Luigi Angeletti – Ambrosio & Commodo, Turin. In their argument, they relied, among other things, on the OPEN DATA data concerning the results of the tests of the National Frequency Agency (ANFR) on more than 500 mobile phones published in the context of the industrial and health scandal (Phonegate).
