The judge has ruled in favor of the government.

Date of judgment 8 March 2023.

We note (as per the judgment):

•”A judicial review is not an appropriate vehicle for determining contested scientific material”

•”Not a case in which the High Court should intervene in respect of a decision that involves issues of technical scientific judgment.”

•”The government has adopted a precautionary approach in its messaging. Although it believes 5G is safe, out of an abundance of caution and on conservative principles it has suggested that those who are worried could, for example unplug the router at night, or not sleep with their mobile phone by their bed and to use their device further away from their body.”

•“Finally, I observe that the individual complaints of adverse health effects may give rise to private law claims for personal injury if those concerned are able to obtain the necessary medical and scientific evidence on causation, and identify appropriate defendants. This may be a more appropriate route than a judicial review and human rights claim, but, of course, that is a matter on which the claimants should seek their own legal advice.” (Lang J)”

By Ben Gartside and Matthew Field, 4 April 2021

The economy will take a hit of £7.4bn due to the slow rollout of 5G if a dispute between landlords and telecoms companies continues to hold back the technology.

Economists have warned reforms that aimed to reduce the rents telecoms operators pay to landlords for deploying new equipment have held up the spread of faster mobile phone signals across Britain.

The 2017 reforms, under the Electronic Communications Code, have instead led to lengthy legal battles as operators attempt to push down rents, while being opposed by uncooperative landowners.

The Centre for Economics and Business Research (CEBR) said the government should adopt alternative rules to rebalance how much site owners receive.

The Government is currently consulting on changes which the CEBR argue would cost landowners £50m per year and set back GDP by billions as 5G installations become mired in disputes.

Protect & Connect, a campaign group supporting landlords which has championed the CEBR report, said it provided evidence the government should change its approach.

Anna Turley, Chair of Protect & Connect said: “The fastest way to achieve the ambition of a digitally connected UK is to ensure a fair deal for site owners, or there is no incentive for anyone to host a site.

“Unfortunately the 2017 reforms have not achieved what they set out to do. Instead of accelerating the roll-out of broadband, something we all want to see, it is clear that the changes have actually hindered it, as operators have sought to maximise the reductions through legal action.”

However, the report was disputed by the Speed Up Britain campaign, which is supported by telecoms companies. The campaign has called on the government to close legal loopholes and make it easier for mobile companies to access and upgrade sites without lengthy negotiations and legal costs spiralling into the hundreds of thousands of pounds.

A spokesman for the Speed Up Britain campaign said: “We agree on the need for Code reform but we believe it should be focused on enabling the existing law to work as the Government intended.

“The current approach brings telecoms infrastructure more into line with other essential services such as the utilities, which is critical if we’re to speed up the roll out of 5G, save consumers significant extra cost, and help the economy to recover from the impact of the pandemic.”

It has recently come to light that Elon Musk’s Starlink satellite internet service has received licensing approval for its user terminals from the U.K.’s communications regulator. The green light given to the Starlink broadband system will allow Musk to compete with terrestrial U.K. Internet providers like BT Group Plc and others including Inmarsat Group Holdings, OneWeb, etc.

It costs £439 upfront, plus £84, for a monthly subscription. The authorization was granted to Starlink back in November last year, according to Ofcom spokesman.

For the uninitiated, Starlink is a satellite internet company developed by Elon Musk’s space-exploration company SpaceX. With the help of Starlink, Musk aims to launch 42,000 small satellites in low Earth orbit. These will help transmit fast internet signals to the earth and help provide superfast internet connections across the globe.

Apart from the UK, Greece, Germany, and Australia have also approved the new system. Also, Starlink has already started testing a beta service in North America where the company has launched hundreds of satellites.

Guest post by Jessica Learmond-Criqui, a partner in employment and executive immigration law at North London firm Learmond Criqui Sokel.

James is a real case whose identity has been changed.

Please meet James. He first started feeling unwell in 1988 when a transmitting mast five metres from his home – which previously had only an aerial at the top as a relay station – had additional capacity added to it that year.

He started to have headaches and migraines which abated within 30 minutes of leaving the house and vicinity of the mast. When several mobile systems were added to the mast, headaches and brain fog were accompanied by burning across his shoulders and back, and a pricking tingling sensation in his body ‘like being electrocuted’.

His symptoms became worse, and his wife also suffered, when Tetra transmitters were added to the mast: stabbing pains in the shoulders, vertigo, blurred vision, pressure band around the head, headaches, cramping of hands, confusion and lack of concentration, disorientation, dizziness, dry cough, hot spots on the spine, to name just a few from a long list.

Caymen iNews, 10th November 2020

Medical experts and practitioners from around the world have united once again to make clear their concerns regarding the health effects of escalating non-ionising radiation (NIR) exposures. NIR is electromagnetic energy ranging from Extremely Low Frequency (ELF) waves right the way up to Ultraviolet (UV). In particular, they are concerned about radiofrequency (RF) emissions from existing mobile phone networks, Wi-Fi, and the rollout of 5G.

Whilst such emissions were historically presumed to be biologically inert, and are still purported to be safe by many to this day, there is now highly credible evidence to the contrary. The main risks associated with exposure to such (wireless) non-ionising radiation in the peer-reviewed scientific literature include: increased cancer risk, cellular stress, increase in harmful free radicals, genetic damage, structural and functional changes of the reproductive system, learning and memory deficits, neurological disorders, and negative impacts on general well-being in humans.[1]

Mounting human epidemiological evidence of increased cancer has now been corroborated by ‘clear evidence’ of carcinogenesis from animal studies. These include the two largest investigations ever undertaken globally, from the widely respected National Toxicology Program (USA),[2,3] and Ramazzini Institute (Italy).[4] What is more, law courts are now validating such links: with compensation for health damages from mobile phone radiation being won in a growing number of cases internationally.[5] Some legal teams are so certain of negative health effects that civil suits for Wi-Fi and other wireless injury are now being brought on a ‘no win no fee’ basis,[6] and insurance underwriters consider related risks to be ‘high’.[7,8]

Hundreds of peer-reviewed scientific studies have demonstrated adverse biological effects occurring in response to a range of NIR exposures below current safety guidelines;[9] however, emissions continue to escalate. Medical evidence of harm has now reached the critical mass necessary to inspire the medical community to step out of their usual roles, stand up and speak out regarding their concerns.

The boss of Highways England is to stand down after criticism over the smart motorway policy.

Jim O’Sullivan, one of the country’s highest paid transport officials, will leave the state-funded company responsible for operating England’s motorways early next year.

The move follows a turbulent 12 months at the organisation, which has been at the centre of a row over the roll-out of smart motorways, routes where the hard shoulder has been removed to create extra capacity.

Exerpt

Mr O’Sullivan, who was paid £456,727 in 2018-19, a rise of 13.5 per cent in 12 months, repeatedly pointed to Highways England data showing that the safety record of smart roads was better than conventional routes.

However, public confidence in the system was heavily dented after a series of high-profile deaths, including of drivers who broke down without being able to reach a lay-by.
