Conclusion
Some combination of 5G/4G may well become part of the wireless access network over the coming decade. However, for this to happen, several factors will influence this future.

Technical standards will need to be completed and spectrum will need to be allocated. Mounting public concern over the health risks of electromagnetic radiation will need to be dealt with and new biological science-based exposure standards will need to be established. Otherwise, public pushback, litigation, and political action will continue to afflict the industry and its plans. It is likely that public skepticism over the flamboyant claims of the tech industry will continue to grow as practical and market realities confront the promises of AVs, VR, AI, and IoT.

The industry may need to bear more of the cost of its small cells as courts and legislators in response to political forces begin to unwind industry’s private appropriation of the public rightsof-way and rein in their de facto public subsidy. A political change at the national level may enable a revitalization of antitrust policy and enforcement that could throttle back the corporate domination and political power of telecom network operators and social media technology giants.

Perhaps most importantly, widespread deployment of local municipal fiber access networks providing far superior fiber service—all the way to the home or office—may mitigate much of the need for wireless access services, as described in the report, Re-Inventing Wires: The Future of Landlines and Networks.

Washington, D. C., December 3, 2018.

The National Institute for Science, Law & Public Policy (NISLAPP) applauds Connecticut Senator Richard Blumenthal (D-CT) [and Congresswoman Anna Eshoo (D-CA)] for pressing FCC Commissioner Brendan Carr, Esq. to provide documentation substantiating the Commissioner’s remarks defending ‘5G safety’.

Business Wire link: https://www.businesswire.com/news/home/20181203006017/en/Blumenthal-Presses-FCC-Commissioner-Brendan-Carr-Disclose

NISLAPP seconds this request. Jim Turner, Esq., President of NISLAPP, says:

“NISLAPP considers it a mistake to place new high-frequency radiating antennas in local communities, in very close proximity to homes, office and schools, when no pre-market health testing at scale has been conducted on the effects of the radiation emitted, to our knowledge, and when much safer hard-wired internet access technologies are readily available. We strongly support Senator Blumenthal’s request of FCC Commissioner Carr to provide the documentation evidencing the FCC’s ‘safety determination for 5G’, along with the supporting scientific citations used in making that determination.”

Senator Blumenthal’s formal request to Commissioner Carr requesting these documents was announced at a press conference in Hartford this morning. In the letter, Blumenthal explained that recently, in a Senate Committee field hearing in South Dakota regarding 5G, Mayor Paul TenHaken of Sioux Falls, SD was looking for “clear direction, talking points, studies that have been done that show that there is no harm to our constituents and to the taxpayers on putting these small cells on towers close to libraries, close to schools, close to their homes”. And that Commissioner Carr responded at the time, saying, “Federal law actually says that state and local governments can’t take [radiofrequency] concerns into account given how much work has gone into this issue at the federal level…Both at the FCC and other expert health agencies in Washington, they stay very much up to speed on these issues and have reached the determination that these are safe.”

Following this exchange, Senator Blumenthal is presently calling on FCC Commissioner Carr to send the following documentation to his office:

The 5G safety determination from FCC and other relevant health agencies to which Commissioner Carr referred during the field hearing.

Current citations for the studies informing that safety determination.

He said his own constituents have similar concerns about 5G, and that he wants to provide them with accurate information.

Senator Blumenthal said we “are interested in acquainting ourselves with the latest studies evaluating the health effects of high-band frequencies and modulations that would be used in 5G networks”. He noted “Most of our current regulations regarding radiofrequency safety were adopted in 1996 and have not yet been updated for next generation equipment and devices”. He also mentioned the large U.S. government funded study by the National Toxicology Program, published this year, using earlier generation technologies (2G and 3G), showed a link between radiofrequency radiation and cancer.

Blumenthal added, “Carriers will also need updated guidelines governing the authorization of devices to be used with 5G”, and “We also believe it is critical for the FCC to act on its March 27, 2013 Further Notice of Proposed Rulemaking and Inquiry to ensure all individuals, and especially those working in close proximity to the hundreds of thousands of small cell facilities to be deployed, are protected from any kind of excess radiofrequency radiation.”

The Communications Workers of America was present at the press conference, as was science writer and expert in electromagnetic fields, B. Blake Levitt. See Levitt remarks.

The National Institute for Science, Law and Public Policy considers Senator Blumenthal’s line of inquiry about the extent of safety evaluations of next generation 5G radiation to be critically important. Camilla Rees, Senior Policy Advisor to NISLAPP, says, “All Members of Congress, as well as state and local government officials, might consider asking similar questions about the new, different and dangerous fifth generation radiofrequency technologies that the telecom industry intends to deploy widely within our living environments, and about which scientists around the world are warning.

International scientists in many countries are calling for a moratorium on 5G until the potential hazards are fully investigated.

WASHINGTON–(BUSINESS WIRE)–Senate Bill S.1357, known as the STREAMLINE Small Cell Deployment Act, and opposed by the National League of Cities, aims to streamline the siting process for small cell antenna deployment throughout the United States, further eroding local control over decision-making about the siting and management of radiating antennas. The National Institute for Science, Law and Public Policy (NISLAPP) is calling on Members of Congress to consider the inadvisability of antenna densification, in the first place, before legislatively mandating the installation of hundreds of millions more antennas across the nation.

NISLAPP’s report, “Re-Inventing Wires: The Future of Landlines and Networks”, presented at the Commonwealth Club of California earlier this year, explains how it came to be that wireless communications, known to be an extremely inferior technology laden with risks, is being mistakenly perceived as a solution and an advancement, and why ‘fiber to the premises’ (rather than fiber to support more wireless antennas) is unquestionably the best technological option to support our economy and society.

As the paper’s author, Timothy Schoechle, PhD, explains in this report, there are 13 negative impacts from wireless access networks and ‘antenna densification’—all of which would be successfully addressed by a hard-wired, ‘fiber optics to the premises’ approach to communications:

1. Speed of Internet access

2. Equal Internet access

3. Quality of voice communication

4. Reliability

5. Energy usage and efficiency (10x more energy is used to power wireless)

6. Resiliency in extreme weather events

7. Value, for the money

8. Safety and cybersecurity

9. Personal Privacy

10. Public health

11. The biological ecosystem

12. Landline phone access when the power goes out, and

13. The integrity of the communications system as a whole, which has become, as described by the paper’s author, Timothy Schoechle, PhD, “hijacked by commercial motivations” and riddled with planned obsolescence and unnecessary future costs for us all.

Given the importance of each of these issues to most Americans, NISLAPP recommends Members of the Senate Commerce, Science and Transportation Committee (which will hold its Oversight Hearing with FCC Commissioners on Thursday, August 16th at 10:00 a.m.)—as well as all member of Senate and House of Representatives—thoroughly familiarize themselves with the superior hard-wired communications options described in “Re-Inventing Wires: The Future of Landlines and Networks”. (Listen to Audio from the Commonwealth Club of California presentation.)

S. 3157, introduced by Senator John Thune (R-SD), would commit the United States to forced wireless antenna installation and the removal of municipalities’ rights to limit antennas for any reason, an egregious erosion of democracy and serious mistake for this country, above all.

Legislators have been misled about the adequacy of wireless Internet access networks. We urge Congress to assure the reliable, safe, energy-efficient and enduring telecommunications infrastructure this country needs and deserves.
